They sued after the fact. They could have sued and gone for an injunction right then and there.

They agreed to the original sanctions, and then realized how pissed people would be, and sued because it was their only recourse.

The NCAA being cowards doesn't change that, but if the truth was really on their side, they could have sued the NCAA right then and there, and gotten an injunction keeping the program up and running.
