How differently that deposition would have gone if Little had copies of the USAG magazine articles (and his Code of Ethics article) to discuss with him. And I also think Little could have done a better job asking questions or probing.

Perhaps he had short a short timeframe to prepare or got frustrated, but he didn't challenge Swarbrick for non-responses:

Q. Let's go through those real quick. Are you aware
of any sexual misconduct scandals involving coaches
and athletes in USA Gymnastics?

A. Yes.

Q. Have you advised USA Gymnastics in that situation?

[Objection discussion]

A. They were clients.

Q. And you're not going to say whether or not you
advised them on sexual misconduct?

A. I'm not going to talk about anything I advised them
on specifically.

He didn't answer the question as to whether he ever advised USAG on sexual misconduct. Perhaps parsing a bit, but that could have been probed better and better preparation and research made it worthwhile.
