I don't think Jack Swarbrick is some monster like Joe Paterno. Absent clearer evidence than I've seen, I believe we are all unwilling to assume he played a willful aiding and abetting role.

That is not what people are trying to determine here. They're trying to determine whether he is fit to be a leader at Notre Dame. In part with Swarbrick as its primary lawyer, USA Gymnastics turned a blind eye to, or at least created a membership and reporting structure under which, the worst sexual abuse scandal in the history of U.S. athletics took place. This involved not just one monster, but dozens of them, for decades, using their positions of authority in gymnastics to molest girls.

Collectively, the leadership of USAG and Michigan State appear to be headed toward a legacy similar to that of Cardinal Law. If Swarbrick played a role of any significance in USAG's failure, he should not be the Athletic Director at ND.
